GENERAL TERMS AND CONDITIONS: Please read this information carefully, as payment of a $400 deposit per person represents your acceptance of the following Terms and Conditions.
NOT INCLUDED IN TOUR PRICE: Transportation by air or otherwise to the tour hotel starting point and from the tour ending point is not included. Hotel parking is not included. Local parking suggestions will be provided prior to the trip. A single courtesy transfer from Birmingham Airport to the hotel is offered. A single courtesy transfer from the Montgomery hotel to Birmingham Airport is offered. All other transfers between airport and hotel are optional and at an additional cost.
Hotel Rooms Before or After Tours – To start the trip relaxed and refreshed, many guests prefer to make hotel arrangements before their tour departs. As a service, we will make hotel reservations before or after your trip on a space available basis upon request. Hotel charges will be added to your tour cost. Airport transfers are not included for these bookings; ask for details when booking.
Personal expenses such as phone calls, porterage, room service, alcoholic and bar beverages, meals (other than those specified in the itinerary), laundry, airline excess luggage charges, and other optional incidental extras are not included.
Optional sightseeing is not included.
Travel protection insurance is recommended but is not included in the tour cost.
LUGGAGE RESPONSIBILITY: Although every effort is made to handle guests’ luggage carefully, we cannot be responsible, assume liability or accept claims for loss or damage to luggage and personal effects due to breakage, theft, or fair wear and tear through hotel, airline and group carrier handling. It is important to have adequate insurance to cover these eventualities.
ITINERARY CHANGES & PRICE FLEXIBILITY: We pledge to make every effort to operate all tours as advertised. We reserve the right to alter or curtail the itinerary, or substitute sightseeing, guides, speakers, hotels, and / or conveyances as deemed necessary. Any savings realized by these changes will be refunded to passengers. Any resultant added expense will be covered by the Association.
HOW TO MAKE A RESERVATION: To Make a Reservation, book directly via the link at www.civilrightstours/duke; connect with your Duke Travels advisor, or phone us at 919-684-2988. The trip requires a minimum of 10 participants. If by December 12, 2022, there are fewer than 10 reservations, the trip will be canceled, and any deposits already paid will be refunded.
PAYMENTS: Upon receipt of your payment either online, by phone, or via mail for your deposit, your credit card provided will be charged the balance of $3,299 on December 2, 2022. For those paying the Single Supplement, an additional $600 will also be charged on December 2, 2022.
CANCELLATIONS, REFUNDS, AND CHANGES: If you must cancel your trip, the effective date of cancellation will be upon Alabama Civil Rights Tourism Association’s receipt of your notification. Refunds for cancellations are subject to the following per person charges: cancel 90 days or more before departure: $400 charge; cancel 89-65 days before departure: 25% of tour price; cancel 64-45 days before departure: 50% of tour price; cancel 44-30 days before departure: 75% of tour price; cancel 29-0 days before departure: no refund. If you make any changes to your reservation from 90 to 30 days prior to departure, Alabama Civil Rights Tourism Association will apply a $100 per person administrative fee, in addition to any fees or penalties imposed by third parties. Changes are subject to availability and cannot be guaranteed. If your reservation changes from double occupancy to single occupancy, for any reason, you will be charged the single supplement. We understand life occurrences. Your paid slot is transferable to your designee up to the day of arrival.
RESPONSIBILITY, TERMS & CONDITIONS: Duke University, Alabama Civil Rights Tourism Association, its affiliates, and cooperating agencies (hereafter referred to as THEY) act only in the capacity of agents in all matters of transportation and tour operation, and their liability is limited to the terms of the supplier agreements. THEY are not liable for any expenses or injuries due to delays, inconveniences, accidents, expenses or mishaps of any kind whatsoever resulting entirely, or in part, from the negligence of others or from causes beyond their control. THEY can accept no liability or responsibility for injuries, losses or additional expenses due to delays or changes in air or other services, acts of God, sickness, weather, strike, war, terrorism, quarantine, theft, civil unrest or other causes over which THEY have no control. The right is reserved to substitute accommodations or modes of transportation and to make any changes in the itinerary as deemed necessary or caused by changes in transportation schedules. It is the guest’s responsibility to judge the appropriateness of these travel activities to their physical capabilities. THEY take no responsibility for special arrangements or problems incurred by guests physically unable to participate in the planned activities. No refund can be made for absence from the tour unless arrangements are made at the time of booking. The right is reserved to decline to accept or retain any person as a tour member for any reason, which affects the operation of the tour or the rights and welfare or enjoyment of the other tour members. THEY will not discriminate against any individual because of race, sex, creed or nationality. A refund of the cost of recoverable land tour and/or air services is the limit of liability. THEY reserve the right to take photographic or film records of any trip or guest, and may use any record for promotional and/or commercial purposes. All contracts for services are entered into in the state of Alabama and all parties to such contracts submit to the exclusive jurisdiction of the courts of the state of Alabama.
ARBITRATION: Any controversy or claim arising out of or relating to this Agreement or the performance there under, including without limitation any claim related to bodily injury, property damage or death, shall be settled by binding arbitration in Birmingham, Alabama in acĀcordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy. This agreement to arbitrate does not waive or modify the liability release contained in the foregoing paragraph.
THE COST OF OUR JOURNEY INCLUDES: Services of the Alabama Civil Rights Tourism Association as ground operator; all entrance and speaker fees; the services of an experienced program manager and study leader; meals as specified in the itinerary.
ITEMS NOT INCLUDED IN OUR JOURNEY: Airfares, Transportation to Birmingham and from Montgomery; Travel Protection Plan, Items of a personal nature, such as alcoholic beverages, camera fees, etc.
HEALTH AND MEDICAL ISSUES
We request that you be in good health to participate in this Alabama Civil Rights Tourism Association tour. There is a reasonable amount of walking, and you must be able to get on and off motorcoaches on your own. We regret that we cannot offer individual assistance; in such cases you must be accompanied by a companion who will assist you. Please note that many of the sites on our tour itineraries, for reasons beyond our control, do not accommodate wheelchairs. Please call or e-mail us to inquire and we will do our best to answer any questions you may have. We reserve the right to remove anyone whose physical or mental condition, in our opinion, compromises the operation of the tour or detracts from the enjoyment or safety of the other passengers. In that event, Alabama Civil Rights Tourism Association assumes no financial responsibility for any unused portion of the tour.
